The agreement between you and Heer for using the app and heer.now.
In short: These Terms are a contract between you and GMRM Technologies Ltd, the company behind Heer. By creating an account or using the app, you agree to them. Heer helps you discover events and doesn't sell tickets itself — purchases happen on the promoter's or venue's own site, at their own terms. Be respectful, don't misuse artist or community profiles, and you can close your account at any time.
These Terms & Conditions ("Terms") are a legal agreement between you and GMRM Technologies Ltd, a company registered in England and Wales (company number 16723875) with its registered office at 43a Fitzjohns Avenue, London, NW3 5JU, United Kingdom ("Heer," "we," "us," or "our"). They govern your access to and use of the Heer mobile application and the heer.now website (together, the "Service").
By creating an account, or by accessing or using the Service in any way, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you don't agree to these Terms, please don't use the Service.
Heer is an event-discovery platform — think of it as a shared calendar for the things happening around you. Through the Service you can browse and search for events, follow artists, venues, and organisers, save events you're interested in, and manage or claim an artist, venue, or community profile. Heer aggregates event information from public sources, our partners, and content that users and organisers add or claim.
Heer is a discovery and information service. We are not a ticketing platform, box office, or payment processor. Where an event has tickets available, we may link you through to the promoter's, venue's, or a third-party ticketing platform's own website to complete your purchase, as described in Section 7.
You must be at least 13 years old to create an account or use the Service. By using the Service, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation (for example, to manage a venue or artist profile), you confirm that you're authorised to act on that organisation's behalf and to bind it to these Terms.
To use most features of Heer, you'll need to create an account using your phone number, verified by a one-time passcode sent via SMS or WhatsApp. You agree to:
You can close your account at any time by contacting us at support@heer.now and requesting deletion. We handle account and data deletion as described in our Privacy Policy.
You retain ownership of any content you submit, post, or display on or through the Service ("User Content"), such as profile information, saves, follows, reviews, or claim requests. By submitting User Content, you grant Heer a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, and distribute that content solely for the purpose of operating, promoting, and improving the Service. This licence ends when you delete the content or your account, except to the extent it has been shared with others and they haven't deleted it, or we're required to retain a copy for legal reasons.
You're responsible for the User Content you submit and confirm that you have the necessary rights to share it, and that it doesn't infringe any third party's rights or violate any law.
When using the Service, you agree not to:
We may review, moderate, and remove User Content, and suspend or terminate accounts, that we reasonably believe violate this section, though we're not obliged to monitor all content on the Service.
Where an event, artist, venue, or organiser hasn't yet claimed their profile on Heer, we may create or populate a profile for them using publicly available information, so users can discover their events. If you're the rightful representative of an unclaimed profile, you can request to claim it by contacting us at support@heer.now, along with reasonable evidence of your authority to manage it (for example, a verified social media account, official email domain, or other proof we may request).
Once a profile is claimed, you're responsible for the accuracy of the information you manage on it. We reserve the right to request further verification, decline a claim request, or reassign or remove a profile where we reasonably believe it's being misused, is inaccurate, or the claim was made without proper authority. If you'd like an unclaimed profile referencing you or your organisation removed rather than claimed, contact us and we'll action that request.
Event information on Heer is aggregated from public sources, data partners, and content added by organisers and users. While we try to keep listings accurate and up to date, we don't guarantee the accuracy, completeness, or timeliness of any event information, including dates, times, venues, line-ups, pricing, or ticket availability. Always confirm details with the official event organiser or ticketing provider before making plans or purchases.
Heer does not sell tickets or process payments. Where you choose to purchase tickets or merchandise related to an event, you'll be directed to a third-party website operated by the promoter, venue, or a ticketing platform, and that purchase will be governed entirely by that third party's own terms, policies, and customer service. We are not a party to that transaction and have no responsibility for it — including for refunds, cancellations, event changes, or disputes. We may earn a referral commission from these third parties when you complete a purchase after clicking through from Heer, at no extra cost to you.
The Service, including its design, features, graphics, logos (including the Heer name and mark), and underlying software, is owned by GMRM Technologies Ltd or our licensors, and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use, subject to these Terms. All rights not expressly granted to you are reserved.
You may not use the Heer name, logo, or branding without our prior written permission, except as necessary to accurately describe your use of the Service (for example, linking to your claimed profile).
If you believe content on the Service infringes your copyright or other intellectual property rights, please send a notice to support@heer.now including: (a) identification of the work you believe is infringed; (b) identification of the material you believe is infringing, and its location on the Service; (c) your contact details; and (d) a statement that you have a good-faith belief the use is unauthorised, and that the information you've provided is accurate. We'll review and respond to valid notices, and may remove or disable access to the material in question.
The Service may contain links to, or integrate with, third-party websites, platforms, or services that we don't own or control (including ticketing sites, social platforms, and SMS/authentication providers). We're not responsible for the content, policies, or practices of any third party, and including a link or integration doesn't imply our endorsement. Your use of any third-party service is at your own risk and subject to that party's own terms.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.
You agree to indemnify and hold harmless GMRM Technologies Ltd, its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your misuse of the Service, except to the extent caused by our own breach, negligence, or wilful misconduct.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, if we reasonably believe you've violated these Terms, engaged in fraudulent or unlawful conduct, or where we're required to do so by law. We'll aim to give you notice where reasonably possible, but may act immediately where necessary to protect the Service, our users, or third parties. Sections of these Terms that by their nature should survive termination (including Sections 8, 9, 11, 12, 13, and 16) will continue to apply.
We're always working to improve Heer, and may add, change, or remove features at any time. We may also update these Terms from time to time — if we make material changes, we'll notify you through the app or by other reasonable means before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms. If you don't agree, you should stop using the Service and may delete your account.
These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales will have non-exclusive jurisdiction over any dispute, meaning you may also be able to bring proceedings in your own country if applicable local law gives you that right. If you're a consumer resident in the EEA, you may also benefit from any mandatory protections of the law of your country of residence.
